Jerrod Metsker may face death penalty.

The Wayne County Prosecuting Attorney and the Wayne County Sheriff issue the following joint press release:

On Friday, December 20, 2013, charges were presented to a Wayne County grand jury by the Wayne County Prosecuting Attorney, and the grand jury returned an indictment on Jerrod E. Metsker with charges of Aggravated Murder (2 counts), Kidnapping (3 counts) and Rape (2 counts), all with specifications. The charges are more specifically set out below.

If the defendant is found guilty of either or both of the Aggravated Murder counts, and any one of the specifications thereunder, the death penalty would be available as a possible punishment.


The Wayne County Sheriff served a copy of the indictment upon the defendant on Friday, December 20, 2013, at approximately 5:00 p.m. Bond has been set by the Wayne County Common Pleas Court at one million dollars cash or surety. Since the defendant has now been indicted, the preliminary hearing scheduled in the Wayne County Municipal Court for Monday, December 23, 2013, at 10:00 a.m., will be cancelled. The next proceeding in this case will be the defendant’s arraignment in the Wayne County Common Pleas Court, the date and time of which is yet to be determined


COUNT ONE: Aggravated Murder, a felony of the unspecified degree, alleging that on or about December 14, 2013, Jerrod E. Metsker, did purposely cause the death of Reann Murphy, born October 30, 2004, who was under the age of thirteen years of age at the time of the commission of the offense, with the following specifications:

That offender purposely caused the death of another who was under the age of thirteen;

That the offender committed the offense with a sexual motivation;

That the offense was committed while the offender was committing, attempting to commit, or fleeing immediately after committing or attempting to commit Kidnapping;

That the offense was committed while the offender was committing, attempting to commit, or fleeing immediately after committing or attempting to commit Rape;

That the offense was committed for the purpose of escaping detection, apprehension, trial, or punishment for Kidnapping;

That the offense was committed for the purpose of escaping detection, apprehension, trial, or punishment for Rape.




COUNT TWO: Aggravated Murder, a felony of the unspecified degree, alleging that on or about December 14, 2013, Jerrod E. Metsker, did purposely cause the death of Reann Murphy, born October 30, 2004, while committing, or attempting to commit, or while fleeing immediately after committing or attempting to commit the offense of Kidnapping and/or Rape, with the following specifications:

That offender purposely caused the death of another who was under the age of thirteen;

That the offender committed the offense with a sexual motivation;

That the offense was committed while the offender was committing, attempting to commit, or fleeing immediately after committing or attempting to commit Kidnapping;

That the offense was committed while the offender was committing, attempting to commit, or fleeing immediately after committing or attempting to commit Rape;

That the offense was committed for the purpose of escaping detection, apprehension, trial, or punishment for Kidnapping;

That the offense was committed for the purpose of escaping detection, apprehension, trial, or punishment for Rape.


COUNT THREE: Kidnapping, a felony of the first degree, alleging that on or about December 14, 2013, Jerrod E. Metsker, did purposely remove Reann Murphy, born October 30, 2004, a child under the age of thirteen, from the place where she was found or restrained her liberty for the purpose of facilitating the commission of a felony to wit: Rape, with the following specification:

That the offender committed the offense with a sexual motivation.


COUNT FOUR: Kidnapping, a felony of the first degree, alleging that on or about December 14, 2013, Jerrod E. Metsker, did purposely remove Reann Murphy, born October 30, 2004, a child under the age of thirteen, from the place where she was found or restrained her liberty for the purpose of terrorizing or inflicting serious physical harm upon R.M., with the following specification:

That the offender committed the offense with a sexual motivation.

COUNT FIVE: Kidnapping, a felony of the first degree, alleging that on or about December 14, 2013, Jerrod E. Metsker, did purposely remove Reann Murphy, born October 30, 2004, a child under the age of thirteen, from the place where she was found or restrained her liberty for the purpose of engaging in sexual activity against her will, with the following specification:

That the offender committed the offense with a sexual motivation.

COUNT SIX: Rape, a felony of the first degree, alleging that on or about December 14, 2013, Jerrod E. Metsker, did engage in sexual conduct with Reann Murphy, born October 30, 2004, who was not the spouse of the offender, whose age at the time of the offense was less than thirteen years of age, to wit: nine years of age, and that the offender did cause serious physical hear to the victim.


COUNT SEVEN: Rape, a felony of the first degree, alleging that on or about December 14, 2013, Jerrod E. Metsker, did engage in sexual conduct with Reann Murphy, born October 30, 2004, who was not the spouse of the offender, whose age at the time of the offense was less than ten years of age, to wit: nine years of age.

If the defendant is found guilty of either or both of the Aggravated Murder counts, and any one of the specifications thereunder, the death penalty would be available as a possible punishment.
